A new study from the University of Exeter Law School suggests that quantum computing could challenge traditional understandings and enforcement mechanisms of copyright law.
Dr James Griffin, the leader of the research, says quantum computing will enable new levels of tracking and tracing, allowing legal owners to assert their rights more effectively. However, this heightened surveillance also raises concerns about copyright infringements.
Dr Griffin notes that quantum computers will possess the computational power to discern nuanced judgments regarding copyright violations, blurring the lines of legal interpretation in ways yet to be explored fully. While enforcement efforts may intensify, the study suggests that certain forms of content, particularly those embedded with quantum watermarks, will enjoy enhanced protection.
“Quantum computers will have sufficient computing power to be able to make judgment calls as to whether or not re-uses are likely to be copyright infringements, skirting the boundaries of the law in a way that has yet to be fully tested in practice,” said Griffin.
“Copyright infringements could become more commonplace due to the use of quantum computers, but the enforcement of such laws could also increase. This will potentially favor certain forms of content over others.”
Moreover, the advent of quantum computing is anticipated to facilitate the proliferation of AI-generated artistic works, as existing content can be repurposed and reimagined on a massive scale.

“A quantum paradox is thus developing, in that there are likely to be more infringements possible, while technical devices will simultaneously develop in an attempt to prevent any alleged possible or potential copyright infringements. Content will increasingly be made in a manner difficult to break, with enhanced encryption,” continued Griffin.
“Meanwhile, due to the expense of large-scale quantum computing, we can expect more content to be streamed and less owned; content will be kept remotely in order to enhance the notion that utilising such data in breach of contractual terms would be akin to breaking into someone’s physical house or committing a similar fraudulent activity.”
